PORT MORESBY, Papua New Guinea (The National, March 31) – The Papua New Guinea National Court has quashed the government’s decision to terminate Mr David Nelson as managing director of the National Forest Authority (NFA) in October 2003.
Justice Sir Kubalan Los, however, did not order Mr Nelson’s reinstatement, taking into account that his contract would expire on May 27 this year.
He directed the Government to pay him his dues up to the end of the contract.
In his application for a judicial review, Mr Nelson had named Forest Minister Patrick Pruaitch, the NFA board, the National Executive Council and the State as defendants.
He was granted the review on April 14, 2004. The defendants appealed and lost.
In his ruling, Justice Sir Kubalan said the defendants had raised issues which had already been dismissed by the Supreme Court in November 2003.
