GUAM JUDGE RULES GUTIERREZ WON GUBERNATORIAL RACE

HAGATNA, Guam (February 17, 1999 - The Honolulu Advertiser)---A Guam judge has dismissed an election fraud lawsuit filed by unsuccessful Republican gubernatorial candidate Joseph Ada.

Superior Court Judge Joaquin V. E. Manibusan, Jr. yesterday rejected Ada’s claim of massive voter fraud in the November election. The judge ruled that incumbent Carl T. C. Gutierrez, a Democrat, should be named as winner.

Ada claimed that the Gutierrez campaign organization conspired to allow voting by non-U.S. citizens, non-Guam residents and dead and underage people.

Earlier, a federal judge ruled in favor of Ada and ordered a runoff election. Gutierrez has appealed that ruling to the 9th U.S. Circuit Court of Appeals.
