FIJI WATER LOSES LAWSUIT OVER AUSTRALIA MARKETING RIGHTS

SUVA, Fiji (Fijilive, Feb. 28) - Fiji's leading bottled water 'Fiji Water' lost its case in the Australia Federal Court on Tuesday against close rival 'Island Chill' over exclusive rights to market water in Australia.

Dayals (Fiji) Artesian Waters Limited, the owners of 'Island Chill' are now seeking close to FJ$1 million [US$605,000] in damages.

Managing Director, Mr. Jay Dayal said that the litigation by Natural Waters of Fiji had no basis and was designed to suppress the momentum and ultimately kill their interest in the Australian export market.

"I urge the Government to act without delay to urge by all possible mean Fiji Water from repeating this in the interest of saving the water bottled industry as fighting such cases is really expensive."

In passing her judgment, Federal Judge, Justice Annabelle Bennett said the causes of action are each founded on the assertion that Island Chill's packaging shares a sufficient number of the features of Fiji Waters.

She said that there were no specifics to suggest that the two companies had similar representation.

Natural Waters of Fiji says they will not comment on the matter for now.
